Terms of Use and Ordering Terms

These terms are an agreement between you and [pending: legal business name], doing business as Pollería Las Brujas (“we” or “us”). They apply when you use lasbrujaspollos.com or order through it. By using the site or placing an order, you accept them. If you don’t accept them, please don’t use the site.

Our Privacy Policy and our Refund and Cancellation Policy are part of these terms.

Placing an order

• You can order as a guest; you don’t need an account. To place an order you must be at least 18, or have a parent’s or guardian’s permission.
• Please check your order before you send it. You are responsible for the items, the phone number and the delivery address you give us.
• When you place an order, you are offering to buy. We accept it when we confirm it by email or on the order page. Until then, we may decline it.
• We may decline or cancel an order if the address is outside our delivery area, an item is no longer available, a price was wrong, we suspect fraud or the kitchen can’t take more orders. If you already paid, we refund you in full.
• We take online orders only during the opening hours shown on the site, and we may pause online ordering when the kitchen is full.

Prices, sales tax and availability

• Prices are in U.S. dollars. We may change them at any time; the prices shown when you place your order are the ones you pay.
• We add Florida sales tax, including any county surtax, at the rate that applies. Checkout shows the tax before you pay.
• If an item or sauce runs out after you order, we will call or text you to offer a substitute or refund that item.
• If a price on the site is clearly wrong, we will contact you before we prepare the order, and you can accept the correct price or cancel.
• Photos show how we serve our dishes. Your food may look a little different.

Delivery and pickup

• Our own drivers deliver up to 10 miles from our Clermont store for the base fee. Beyond that, we add $1.00 for each extra mile.
• The base delivery fee is $3.99. Delivery is free when your subtotal is $40 or more. Delivery orders have a $15 minimum subtotal. Checkout shows the exact fee before you pay.
• If we can’t confirm the distance to your address online, we confirm it with you before we send the order.
• The times we show (about 30–45 min for delivery and 15–20 min for pickup) are estimates. Traffic, weather and busy hours can make an order late, and we can’t guarantee a delivery time.
• For delivery, someone needs to be at the address and answer the phone number on the order. Our Refund and Cancellation Policy explains what happens if we can’t hand over the order.

Tips

Tips are optional. You choose a percentage of your subtotal at checkout, and you can change it or choose no tip. All tips go to our staff.

Payment

You can pay in cash when we deliver your order or when you pick it up. Please have the amount ready, because our drivers may not carry much change. When checkout offers card payment, you can also pay by card, Apple Pay or Google Pay through Stripe. By paying by card, you authorize us to charge the order total, including tax, delivery fee and tip. We do not store card numbers.

Catering orders

Catering orders need at least 24 hours’ notice before the time you want the food. A catering order is confirmed only when we confirm it to you by email or phone, with the menu, quantities, price and time. Our Refund and Cancellation Policy covers catering cancellations.

Food allergies and food safety

Our menu does not list the allergens in each dish. We prepare all our food in one kitchen, with shared equipment and surfaces, so any dish can come into contact with any ingredient we use. That may include the major food allergens named by the U.S. Food and Drug Administration:

• milk
• eggs
• fish
• crustacean shellfish
• tree nuts
• peanuts
• wheat
• soybeans
• sesame

We cannot guarantee that any item is free of any allergen, and our ingredients and suppliers can change. If you have a food allergy or intolerance, call us at [pending: phone number] before you order and ask about the dish. If even a trace of an allergen could make you sick, please don’t order from us.

Eating raw or undercooked meats, poultry, seafood, shellfish or eggs may increase your risk of foodborne illness. Eat hot food soon after you receive it, and put leftovers in the refrigerator within 2 hours, or within 1 hour if it is hotter than 90°F outside.

Promotions

Each promotion or coupon code has its own conditions, which we show with it. Unless a promotion says otherwise, you can use one code per order, codes can’t be combined or exchanged for cash, and they expire on the date shown. We may end a promotion at any time, but we will honor orders we already confirmed.

Using the site

You agree not to:

• place fake orders or use someone else’s payment details without permission;
• give false contact or delivery information;
• harass or threaten our staff or drivers;
• try to break into the site, overload it, or copy its content with bots or scrapers;
• use the site for anything illegal.

If you do, we may cancel your orders and block your access to the site.

Our content

Our name, logos, photos, menu descriptions and site design belong to us or to the people who license them to us. You may view and print pages for your own personal use. Any other use needs our written permission. If you send us ideas, reviews or suggestions, we may use them without paying you.

Other services

The site uses or links to services run by others, such as Stripe, Google Maps, Instagram, Facebook and WhatsApp. Their own terms apply to them, and we are not responsible for their content or how they work.

Disclaimers

We provide the site “as is” and “as available.” To the extent the law allows, we disclaim all warranties about the site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the site will always be available or free of errors. Nothing in these terms limits rights you have by law that cannot be waived, including rights about the safety of the food we sell.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from your use of the site or your order. Our total liability for any claim about an order is limited to the amount you paid for that order. For any other claim about the site, it is limited to $100.

These limits do not apply to death or personal injury caused by our negligence, to fraud, or to any liability that Florida law does not allow us to limit.

Indemnity

If someone makes a claim against us because you broke these terms or the law, or misused the site, you agree to cover our reasonable costs of that claim, including attorney’s fees.

Governing law and disputes

Florida law governs these terms and any dispute about the site or an order, without regard to its conflict of law rules.

If you have a problem, contact us first at [pending: contact email] or [pending: phone number]. We will try to solve it with you within 30 days. If we can’t, either of us may take the dispute to the state courts in Lake County, Florida, or to the federal court for the district that includes Lake County, and you and we agree to the jurisdiction of those courts. Either of us may also bring a claim in small claims court if it qualifies.

General terms

• We may change these terms by posting a new version on this page with a new effective date. The version in effect when you place an order applies to that order.
• If a court finds part of these terms unenforceable, the rest stays in effect.
• If we don’t enforce a term right away, we can still enforce it later.
• These terms and the policies they mention are the whole agreement between you and us about the site and online orders.
